These Terms of Service (“Terms”) apply to your use of WP Experts LLC (“WP Experts,” “we,” “us,” or “our”) services, website, and support systems. By using our services, you acknowledge that you have read, understand, and agree to be bound by these Terms.
By accessing, subscribing to, or using WP Experts services, including enrolling in a paid plan or maintaining an active account, you agree to be bound by these Terms of Service. If you do not agree, you may not use the services.
These Terms apply to all users, clients, and account holders.
WP Experts provides WordPress website maintenance, monitoring, security, performance optimization, and support services as described on our website and within your selected plan.
Services may include:
Updates to themes, plugins, and WordPress core
Security scanning, monitoring, & remediation
Backups & restore support
Performance enhancements
Minor UI/UX fixes and content edits
Technical troubleshooting
Strategy & consultation
Services are limited to ongoing maintenance and support. Custom development, redesigns, feature builds, migrations, or project-based work are not included unless explicitly agreed to in writing.
WP Experts does not guarantee uninterrupted service, error-free software, or specific performance outcomes.
WP Experts supports WordPress Multisite only if each site has its own plan. We reserve the right to modify or discontinue services at any time.
You grant WP Experts permission to access your website, hosting, domain, and related services as reasonably required to perform contracted services.
You are responsible for providing accurate, current credentials and for promptly updating access when changes occur. WP Experts is not responsible for service delays or failures caused by incomplete or revoked access.
You agree to:
Maintain valid hosting, domain registration, and licensing for all required software
Use secure passwords and follow basic security best practices
Maintain independent backups of your website and data outside of WP Experts’ systems
Promptly notify WP Experts of issues, changes, or suspected security incidents
Failure to meet these responsibilities may limit WP Experts’ ability to provide services and may reduce or eliminate liability.
WP Experts may install, configure, or recommend third-party plugins, themes, hosting providers, and external services. These are provided as-is and remain governed by their own terms and vendors.
WP Experts is not responsible for failures, vulnerabilities, outages, pricing changes, or discontinuation of third-party services, even if recommended or configured by WP Experts.
WP Experts takes reasonable measures to secure and maintain WordPress websites; however, no website or system can be made fully immune to cyber threats, software vulnerabilities, or malicious activity.
Security services reduce risk but do not eliminate it. You acknowledge and accept this inherent risk.
Support is provided in accordance with your active plan and published service descriptions.
Requests outside the scope of your plan, including emergency or expedited work, are subject to availability and may incur additional fees based on WP Experts’ current rate schedule.
Plans are billed on a recurring basis unless canceled. You may cancel at any time through the designated account portal or by written notice.
Your plan remains active until the end of the current billing period. No refunds are issued for partial billing periods unless expressly stated in writing.
Continued use of services constitutes authorization for recurring charges until cancellation is confirmed.
To the maximum extent permitted by law, WP Experts shall not be liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, revenue, profits, business interruption, or security incidents, even if advised of the possibility of such damages.
WP Experts provides professional website maintenance and support services but does not guarantee uninterrupted service, error-free software, or complete protection from cyber threats, third-party vulnerabilities, hosting failures, or force majeure events.
WP Experts maintains applicable professional and cyber liability insurance intended to respond to covered claims arising from the services. Where applicable, recovery for such claims shall be limited to the proceeds available under WP Experts’ insurance policies, subject to their terms, conditions, proof-of-loss requirements, and coverage limits.
Except for amounts recoverable under applicable insurance coverage, WP Experts’ total aggregate contractual liability for any claim arising out of or related to the services shall not exceed the fees paid by the client to WP Experts during the three (3) months immediately preceding the event giving rise to the claim.
Unless you request otherwise in writing, WP Experts may reference your website name or display screenshots for portfolio and marketing purposes. You may revoke this permission at any time by written request.
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict of law principles. You agree that any disputes shall be resolved exclusively in the courts located in Pennsylvania and waive any objections to venue.
WP Experts reserves the right to update these Terms. Material changes will be communicated when reasonably practicable. Continued use of services after changes constitutes acceptance of the revised Terms.
WP Experts shall not be liable for delays or failures caused by events beyond reasonable control, including natural disasters, power outages, labor disputes, hosting failures, or acts of war.
These Terms constitute the entire agreement between you and WP Experts and supersede all prior communications. If any provision is found unenforceable, the remaining provisions shall remain in effect.
